To President Joe Biden and Vice President Kamala Harris: Make the AI Bill of Rights federal policy
In October 2022, the White House Office of Science and Technology Policy (OSTP) released a Blueprint for an AI Bill of Rights, outlining how to use artificial intelligence (AI) responsibly moving forward. In the Blueprint, they acknowledge that “algorithms used in hiring and credit decisions have been found to reflect and reproduce existing unwanted inequities or embed new harmful bias and discrimination,” amidst other harms.
But the principles outlined serve only as a guide, with no legal binding. While AI seems like a new technology, it is moving fast—without any regulation or guardrails to keep it in check. To ensure implementation and make the Blueprint more effective, we need the President to codify the AI Bill of Rights into federal policy through an executive order.
We joined the Center for American Progress, The Leadership Conference on Civil and Human Rights, the Center for Democracy & Technology, and 60 other organizations to urge the Biden-Harris administration to make the AI Bill of Rights a legally binding policy, securing the rights and safety of the American public and workers impacted by AI. We believe that the AI Executive Order should:
- Make the White House AI Bill of Rights a requirement for all AI systems used by all federal agencies, contractors, and grantees in the forthcoming AI Executive Order.
- Make the AI Bill of Rights binding U.S. government policy for the entire federal government, without exemption for any part of the federal government, including law enforcement or the national security community.
- Lay out an aggressive timeline calling for the submission of agency implementation plans to the Executive Office of the President within 90 days and for full implementation within a year of the AI EO being issued.
- Direct agencies to pursue the creation and implementation of regulations needed to realize the goals of the AI Bill of Rights. New regulations would be in addition to enforcing existing civil rights protections and antitrust law.
- Lead on data privacy by adopting standards for data minimization for federal agencies and supporting federal privacy legislation.
